Terms of use

In short

  • Soundium Market is a place where private individuals buy and sell used music and audio gear. The item is sold by the seller, not by Soundium.
  • The buyer pays through Soundium. We hold the money until the buyer confirms they got the item, or until the confirmation time runs out. Then the money goes to the seller.
  • The buyer pays a 5% Soundium protection fee. The seller pays no fee.
  • Sellers are private individuals, so the consumer right to return an item within 14 days without giving a reason does not apply to these purchases. You are covered by Buyer protection.
  • If a problem comes up, we handle it under the Disputes and returns policy.

1. Who we are

Soundium Market is run by UAB SNDM, company code 307138245, VAT code LT100017757014, T. Ševčenkos g. 18, LT-03111 Vilnius, Lithuania. Contact: market@soundium.com, +370 601 61620. All details — Company details.

Market runs at market.soundium.com, market.soundium.lt, market.soundium.lv, market.soundium.ee and other Soundium Market country domains, and in the Soundium Market app.

2. Our role

  • Soundium Market is a platform. The sale contract is made between the buyer and the seller. Soundium is not the seller of the item, does not inspect it and is not responsible for its qualities, except as set out in Buyer protection.
  • Soundium collects the payment on the seller's behalf, holds the money until the deal is complete and pays it out (see section 6).
  • Soundium itself provides and charges for these services: Soundium protection (the buyer fee) and DPD shipping when the shipment is created through Market. We issue a receipt with VAT for them.
  • On service provider pages (lessons, recording, rental and so on), the service is provided by the provider, not by Soundium.

3. Account

  • You can sign in with email (a code or a link in an email), with Google, and in the app also with Apple. There is no password.
  • You must be at least 18 years old to create an account.
  • One person — one account. You can't transfer your account to someone else.
  • Take care of your email: whoever controls it can sign in.
  • You can delete your account in the app settings or by writing to market@soundium.com. You can't delete it while you have unfinished orders or rentals, or while a buyer can still report a problem with an order that has been paid out (48 hours after the payout). What is deleted and what stays is described in the Privacy policy.

4. Who can sell

  • Market is for private individuals selling their own things. Payouts are received through Stripe as a private individual.
  • If you trade for business purposes (reselling, trading on a regular basis), you can't sell on Market.
  • The listing shows that the seller is a private individual.

These are the current fees. Soundium may change the booking fee; the amount shown before you pay always applies.

Payments are in euros only, by card (and Apple Pay in the app). Card details are processed by Stripe; Soundium doesn't see them.

6. How buying works

  1. The buyer taps “Buy now” or agrees a price with the seller (an offer). Once a price is agreed, it must be paid within 24 hours; for a direct purchase the payment window stays open for 30 minutes.
  2. When you pay, the amount (item + protection + shipping) is reserved on your card. The money is not taken yet. Your bank may ask you to confirm the payment (3-D Secure). After 5 failed payment attempts in an hour (current limit), new payments are refused until an hour has passed since the oldest of those attempts; the page shows the time from which paying works again.
  3. Some payments are checked before shipping: when the card's country doesn't match the delivery country and the total is €300 or more, when it is a new account's first order with a total of €500 or more, when Stripe flags the payment, or when the automatic check itself fails. The new-account first-order rule also applies to service bookings, judged on the full amount paid (for a course — one seat with the fee); the card-country rule does not apply to bookings, as there is no delivery. These are the current limits; Soundium may change them. While Soundium is checking, the seller sees on the order page that the order is being checked and the item must not be shipped yet; a service booking goes ahead as booked, only the payout to the provider waits. If Soundium rejects the payment, the order is cancelled: for an item, the hold on the card is released and nothing is charged; for a service booking, the amount paid is refunded, and for a course already under way, the part for the sessions not yet held. While the payment is being checked, the order is not cancelled automatically — Soundium resolves it.
  4. The seller must ship or hand over the item within 5 days of payment. Once 6 days have passed since payment, an unshipped order is cancelled automatically, the reservation is released and the buyer pays nothing. In the last 6 hours before the cancellation, the item can no longer be shipped or handed over. If the payment was checked, the deadline is 5 days from Soundium's decision, but no later than 5 days 18 hours after payment. If the decision comes so late that the item can no longer be shipped, the order is cancelled, the buyer gets the money back and the seller is not penalised for it.
  5. The money is taken when the seller ships the item with a tracking number or, for an in-person handover, enters the buyer's 6-digit code.
  6. The buyer taps “Got it, all good”. If the buyer neither confirms nor reports a problem, the money is paid to the seller automatically: 48 hours after an in-person handover, 5 days after shipping when the parcel goes to Lithuania, Latvia or Estonia, and 7 days when it goes to another country. If the seller allowed change-of-mind returns in the listing (7 or 14 days), the money is paid out when the return window ends (Buyer protection, section 8). An order of €500 or more is paid out only after Soundium approves the payout (current limit). The same applies to service bookings: when a booking's total (for a course — one seat with the fee) is €500 or more, the provider is paid only after Soundium approves it.
  7. Money paid out goes to the seller's Stripe account. Stripe sends it to the seller's bank on the payout schedule shown in the Stripe account.

7. Rules of conduct

  • Tell the truth about the item and about yourself.
  • Deals and payments happen only through Market. Until an order is paid, phone numbers, emails and bank accounts in chats are hidden, and invitations to pay outside Market are flagged as risky.
  • You may not offer prohibited items, insult, threaten, spam or cheat.
  • Offers: at least 50% of the asking price, valid for 24 hours. In the last 24 hours, one person can make no more than 3 offers or counter-offers in one chat, and a buyer no more than 25 in total. Each new price in a chat must differ from the previous one by at least €1 and at least 2%. If the seller has set a lowest price they accept, an offer at or above it is accepted at once, and a lower one is answered at once with the seller's automatic counter-offer at that price.
  • Listings: no more than 20 new listings and 20 drafts per day; a listing is live for 60 days, after which you need to renew it. For a new account's first 14 days, a new listing posted while 5 public sale listings are already live, and listings priced above €1,500, are checked by Soundium before they appear (current limits; Soundium may change them).

8. What Soundium can do

  • Hide a listing, a service or a provider page, warn a member or suspend an account when these terms or the law are broken. We tell you about every such decision by email and give the reason. A suspended member can't buy, sell, make offers or send messages; their listings are hidden.
  • Resolve disputes between buyer and seller under the Disputes policy and explain the decision to both sides.
  • Reports and disputes are handled by the Soundium team. Some actions (rejecting a report, hiding a listing or review, a warning) may be taken by an automated tool supervised by a person. A person suspends accounts and decides about money. You can ask for any decision to be reviewed by a person.

9. How listings are ranked

On the browse page, listings are ranked like this:

  1. by the day they were last published or renewed, newest first;
  2. within the same day — listings from trusted sellers first (the “Trusted seller” badge);
  3. then by the time they were published or renewed.

On a country address (e.g. market.soundium.lt) you see that country's listings by default. There is no paid boosting. Search filters listings but doesn't change their order.

The “Trusted seller” badge is given automatically if, over 6 months, the seller: sold at least 5 items, shipped at least 90% on time, has a rating of at least 4.8, lost no buyer disputes and cancelled no more than 1 paid order. These are the current criteria; Soundium may change them. The badge is recalculated every night and removed when the criteria are no longer met.

10. Liability

  • Soundium is responsible for its own services: collecting payment, holding the money and paying it out under these terms, Soundium protection, and DPD shipping created through Market.
  • The seller is responsible for the item's qualities, its description and the right to sell it.
  • Soundium is not responsible for losses caused by a member making a deal or paying outside Market.
  • These terms do not limit any rights that cannot be limited by law.

11. Changes to these terms

We tell you about significant changes by email and on Market at least 15 days in advance. The new version applies from the stated date. Every version has a date; the version you agreed to and the date you agreed are stored with your account (you agree when you sign up and when you pay on the Market website).

12. Disputes and law

  • Lithuanian law applies.
  • First, write to us: market@soundium.com.
  • A consumer can settle a dispute with Soundium out of court at the Lithuanian State Consumer Rights Protection Authority (A. Goštauto g. 12, 01108 Vilnius, tarnyba@vvtat.lt, vvtat.lrv.lt) or in court.
